It is presumably too late to retrace our steps now and I think in any case that Hong Kong Section will consider that politically the elimination of corruption in the Public Service must take precedence over other considerations. However I should like to

clarify the terms under which we shall agree to use CR55 and to wean Hong Kong off the idea that it will henceforth be just another part of their regular armoury of disciplinary weapons.

1. I am not in favour of putting to Hong Kong the proposal in the last paragraph of Mr Green's draft ie that Sir Alison Russell's "Notes and Forms" should be updated. I think that this would be a mammoth task and one difficult to justify in terms of time and expense even if we could locate a suitable person to do it. I suggest therefore we omit this paragraph (also see Mr Hall's comment about its last sentence).

2. If, as Mr Bickford suggests in his minute of 7.8.78, Mr Champion's 1974 letter is still valid, then why should it not remain as the basic guide with individual exceptions being considered on their merits. Perhaps r Bickford could have another careful look at the note sent to us by r Hunter to see whether he considers that we can make any useful detailed comments on individual points made, but if Mr Hunter has set out the position accurately except with regard to CR55 why can we not say simply that. I think we must stress forcibly that the use

of CR55 must remain the exception in all cases. I think, incidentally, that John Stewart's letter of 14.2.78 made clear that the use to which CR55 was being put in Yau Ma Tei was exceptional. Any possible "carte blanche" application, which Mr Green fears might be suggested by para 3 of tel.99 of 6.2.78, is surely negated by Mr Stewart's letter.
