3.15 Where the Governor, having had previous service in the home civil service or the diplomatic service, returns to such service and elects to have paragraph 3.10 applied to him the salary to be taken for superannuation purposes in respect of his service as a Governor shall be whichever is the more favourable of the pensionable emoluments actually enjoyed during his service as a Governor or the salary he would

have enjoyed from time to time during his service as a Governor if he had remained in

the home civil service post or diplomatic service post from which he was appointed to

a Governorship and had been granted any increments and all increases appropriate to his grade.

Governors under age 50 special cases

3.16 In special cases where it appears to the Minister that it is impracticable to

find appropriate employment in the public service for a Governor who would be eligible

for a pension under this Scheme if he had attained the age of fifty, and that it is in

the interest of the public service to grant him a pension under this Scheme the

Minister may grant him such a pension notwithstanding that he has not attained that

age.

Death Benefits

3.17 If a Governor dies while he is a Governor the Minister may grant a gratuity of

such an amount not exceeding the equivalent of the annual salary of the Head of the Diplomatic Service at the date of death as is equal to his final pensionable

of the form of

emoluments, less the amount of any award made in respect of his death by the

Government of the overseas territory of which he was Governor, to the person nominated by him to receive it, or (in the absence of a valid nomination) to his personal

representatives. Only a husband or wife may be nominated for the death gratuity; and

if the Governor's marriage comes to an end before his death, any nomination he has

made to his spouse by that marriage under this paragraph becomes invalid forthwith.

3.18

Where a Governor to whom a pension has been granted under paragraph 3.3 was、 before his appointment as a Governor employed in the home civil service or the diplomatic service the like pension and lump sum (if any) may be granted to him as if at the completion of that employment he had retired on medical grounds.
