The authority for legal aid is contained in the Hong Kong Government publication "Legal Aid in Criminal Cases Rules", under the Criminal Procedure Ordinance, Chapter 221, which details in Rule 4 the categories of persons who may apply for legal aid in criminal cases. Rule 13(1) applies specifically to persons. committed on capital charges. The effect of these Rules is to make legal aid more readily available in serious criminal cases than in civil cases under the Legal Aid Urdinance (Chaptor 91).
