Hong Kong on a murder charge. This letter is the latest in a number Kr Stainton has written about Mr Clements since early May. Copies of the earlier correspondence, which was generally concerned with the provision of legal aid for Mr Clements, are attached.
2. Hr Stainton now expresses concern on three issues: the timing of the trial, the conditions under which Mr Clements is being held and his possible removal to the UK if he is convicted. The first two points were raised recently in a letter to the Prime Minister from Mrs Freda Smith, a friend of the Clements family. I attach a copy of the reply. As to the third point, the departmental Legal Adviser has commented that it is unclear what grounds would exist to justify Mr Clements' removal to the UK after his conviction and this view has been endorsed by the Hong Kong Government.
3. I submit a draft reply for Lord Goronwy-Roberts' signature. This is based in part on information supplied by the Hong Kong Government. The departmental Legal Adviser concurs.
