are complicated. This was brought out by Mr. Hampton in cases he referred
to.
Difficult to reconcile Meyrick with Griffiths and have feeling that there was a lot of evidence which did indicate that independent night club owners were conspiring with each other and possibly with the police officers. Another thing Mr. Sceats mentioned was lack of challenging of collection of money and tipping off of establishments. No shred of evidence to show that Defendants could or would have had
any knowledge of these matters and apart from cross-examination to a certain extent as to credit it is really not possible to challenge their evidence although some of the witnesses did not show that their answers were credible. The direct evidence only came from Lau Cheong Wa and it appears also from his evidence to have discussed subject of protection with 2D only on one occasion which seems somewhat strange. No suggestion that 2D was ever heard to make any remark: about 12 or vice versa no direct link between them. The only link alleged by Mr. Sceats is the drafts themselves and it is one month after a short
conversation with Lau that any of the 2defendants' drafts have found in sequence with 1D. 2 cheques of 1D which Mr. Hampton has dealt with. Mr. Sceats referred to the murder case but the defence was in a considerable difficulty over that matter not only as a result of objections and as a result of the police file disappearing. file like that can't be found one has to do one's best to replace the
sap. It was after all a serious matter as also was the other memo
in the file which related to the anonymous letter. My learned friend when mentioning the conversations which were alleged to have taken place between 1st and 2nd defendants said there were no detective
station sergeants in the Division at that time. 1 submit that is
erroneous and I have searched the document I have found no reference to
Chiu's not being detective station sergeant at that time. le referred to that twice. He was asked by ir. Hampton why DDI had not gone to see D1 but he never said about there's not being a Detective Station ergeant. Further my learned friend suggested that during the conversation that Lau says took place between himself and 2nd defendant, it was suggested that 2D would leak information in advance. again my note of that evidence i could not even find that suggestion coming from Lau.
