learned friend's piece of paper and initial i is what he has clearly overlooked that Clarke said in addition to making the statement about Liu Chong Hing and what Clarke said is "Information has been received that you (D1) sent money out of Colony by purchasing drafts at Liu Chong Hing Bank". This is what Clarke said. Clarke advised that the information upon which his initial interview was based came from Lau. How could, Your Honour, the man with the piece of paper have imagined in February at date of Clarke's interview that D1 was buying his own drafts and sending them out of the Colony if a piece of paper had been provided with the infor- mation, that someone else should do it for him. Any direct corroboration which my learned friend seeks to get involving D1 appears to be mis- information, inaccurate gossip. In my submission this man's testimony should be totally disregarded by the Court.

If he alleges that during his first 7 to 10 days after a Lak Shing is transferred to Bay View Folice station, he lived and worked out of his office, that one day during that period he saw the first accused and later that day was told by a to go and purchase something it emerges and Your Honour has it from the statement used to contradict this witness this does not appear to coincide with what he said before, nevertheless he was adamant in cross-examination that this is what took place. The first draft purchased under the name Cheng Cheuk Fun was apparently purchased on the 20th June. Very surprising this was F115 2 drafts on 20/6. P22 disclose another 2 drafts on 20th June. In respect of all these drafts except P31 Cheng not only neutrally could not recognize his signature
