arrest and trial in February 1975. Your Honour will recall that

lir. Clarke told Court when he interviewed 14 on 24 or 25/2 he did not at that time have in his person any bank drafts which had subsequently been produced in this case. In fact it would appear that information Mr. Clarke acting on was inaccurate insofar as "Chiu Tak had bought bank drafts for 14 from Liu Cheong Hing Bank". In fact none of the

drafts in case emanated from the bank. when Mr. Guy saw 14 on 13/3/75

he was then in possession of P3 and at that stage he asked 14 Whether his name was C.J.M. Cunningham the name which appeared in P5.

At no

stage was it put to Mr. Guy Mr. Clarke or Mr. Lau that Lau was fed

information by ICAC on this matter. Where did Lau get 3rd initial from unless from 14 himself in the manner Lau has deposed. A further indication that Lau was telling truth is purchasers of bank drafts initially stated that particulars given to them were always supplied to them on a piece of paper. They did not know who they were buying for. Lau is consistent with other witnesses in the way 14 indicated his requirements for payment.

Overwhelming inference arises in particular draftin question 2nd accused

gave instructions which ultimately were executed by Mr. Cheng for remittances to be sent to specified accounts. The use of those 2 cheques by Mr. Cheng strengthens the strong inference that Barclays Old Trafford Account was account of 1A. As to weight to attach to bank documents admitted if Your Honour views them as being corroboration
