i am senior Investigating officer of ICAC. uroup head of ICAC concerning with inquiries which led to this case being brought to this Court. I made notes cither at the time or immediately following inter- views in my official pocket book. In these notes I detailed the time place and date. Hir. Cunningham. I spoke to r. Cunningham. (Refers to pocket book with leave) I said:" been received that you have sent a considerable amount of money out of the Colony by purchasing bank drafts. Our information is that they have been purchased from the Liu Chong Hing Bank. Do you have anything to say about this?" Mr. Cunningham said: "2 understand correctly what you are saying Mr. Clarke but I have nothing to say until I have consulted/ my colicitor. I haven't got one but still". I then said: "This is entirely up to you. The information is that sergeant Chiu Tak bought the drafts from the Liu Chong Hing Bank and rir. Cunningham replied:
ar. Chiu Tak ic a liar". I then said: "Are you denying that any drafts were purchased by you?" and he replied: "I don't want to malte any statement at this point until I have a solicitor. A telephone and telephone directory were then mace available to Mr. Cunningham and he nade a telephone call. A short while later hit solicitor came to the Office and later left in company with Mr. Cunningham. At that stage, no drafts were located bought by or for r. Cunningham. I received information hich I put to hr. Cunningham from my superior officer, Mr. Norman Whiteley who is Assistant Director of Operations. I next saw Hr. Cunningham on Friday, 2nd May in company with Mr. Guy I visited Mr. Cunningham's home at liansfield Road and was present then hr. Muy served him with a notice issued under sec. 14 of the Frevention of Bribery Ordinance. I saw Mr. Cunningham on yet another occasion at 8.30 a.m. on Friday 19/9/75 accompanied by Mr. Hattress, another officer of ICAC. I visited Mr. Cunningham's home at Mansfield Road, and I told him I wished him to accompany me to the Cperations Department of the ICAC where I wished to put further questions to him. He asked me what would happen if he refused to accompany me and he was told under the circumstances he would be arrested.
