In July and August, 1973 the two accused were serving officers in the Police Force, the 1st accused being a station serpent in Wanchai Police Station and the 2nd accused a detective sorgcant attached to the G.I.D. Wanchai.

The first charge relates to an alleged conspiracy to defeat the course of public justice in that the 1st and 2nd accused conspired with Live named persons to act contrary to their public duty as police officers in relation to a police investigation into a caso of homicide and wounding which occurred at the Cactus Apartmont, Leighton Road, Wanchai on the 19th July, 1973.

The second charge concerns the 1st accused only and relates to a charge of perjury in that on the 27th November, 1975, being a vituoss in the trial of two persons, Cuminglan and Thompson, i the Victoria District Court, the 1st accused kovingly and falsely swore that he did not meet one LEUNG Wing-sang in the Harbour Hotel in the presence of one Tai B some time before the ariest of the said ILUNG Wing-sang.

The third and fourth charges concern the 1st accused and relate to alleged perjury committed on the 11th March, 1976 before Ir. Justice YAG, sitting as a Commissioner in a Commission of Equift. The fifth and sixth charges relate to alleged perjury Bquiry. committed on the 12th March, 1976 by the 2nd accused before the same vormission of Enquiry. Particulars of there charges are sat

out in the charge chest.

In the early hours of the 19th July, 1973 a group of persons attacked another group of persons at the Cactus Apartment House in Leighton Road in Wanchai. As a result of that attack a ben

died from a fall from a height apparently whilst trying to evade his attackers. Another six persons attacked were wounded. That same day the police classified this attack as one of murder and wounding.

HUNG Ving-sang testified that in July, 1973 he was a member of the 14 Triai Society and thatin t early hours of the 1961 July, 1973 be wont, on the instructions of the sixth prosecution vitness, with about another ten persons, to the Cactus Apartment House where an attack took place. Although, on the evidence before me, I do not ko what actual part LUNG played in the attack, in my view it was certainly more than he indicated in his evidence. LEULIG, some days later, vent into hiding, first with CHAN Loi-fat and later with Țl. îze-leung, both the latter being named co-conspirators.

Sotween the 19th and 23rd July, 1973 twenty-two persons vere arrested in various police raids and one of the persons so arrected was the sixth prosecution witness. In this judquent
