An Illegal Judgment Without Trial

میله

AFFIDAVIT I

I, Thomas Feng-ming TUNG, solemnly make under oath the following statement which is the absolute truth and nothing but the truth:

(*) asked me to plead "NOT GUILTY" to Hongkong Justice of Peace Court so that the case would come to his court to be tried by him.

(1) Magistrate

(2) Magistrate

said to me: "You have no intention to deceive. Criminal Law requires intention. to clear up by a trial.""

You had better

(3) At his home, Magistrate Lo Hing-shing opened his hands saying

to me:"Look! You did not give anything to me!"

H

(4) At the open court, Magistrate did not try the case but asked

me to go out to Kongso with the prosecution witness Mr.

In Cantonese parlance, Konso means "bargain for bribe (5) The prosecution witness Tam Hung said to me: "I can talk to

Magistrate for you. I always go to his room to talk cases for others. If not, you will at least be fined for $500. (6) In the second session,

to complain the extortion by the prosecution witness am ung, Magistrate Lo Hing-shing threatened me by saying: "Mr. TUNG, this is bad for you!" When I said again, he pretended to be angry saying: I can- not understand you!" When I tried to say the third time, he suddenly shouted out at the top of his voice: "Defendant is guilty! Defendant is guilty! Defendant is guilty!" like a mad man. Magistrate Lo Hing-shing maliciously created a great commotion of terrorism in order to frighten an innocent de- fendant into silence and submission. So a judgment without trial. (7) Magistrate Lo Hing-shing allowed his broker and prosecution

witness Tam Hung to bring a group of Teddy-boys clapping hands loudly in the court-room in celebration of their victory to make the court look like an orchestra house.

(8) Magistrate Lo Hing-shing destroyed the record of the case

and refused to write a written judgment for the defendant to appeal. (9) Magistrate

wrote a secret letter to Director of Education to jeopardice the chances of my promotion. (10) Magistrate

allowed the police department to keep a secret record to smear my reputation permanently without my knowledge of it.

(11) In fact, before trial and after my consultation with Lo Hin -shing at his home, the China Bus Compapy Secretary Mr.Hew A lan has ordered the prosecution witness

to accompany

me to the Police Station and to the Magistracy to withdraw the case because this Bus Inspector had not been authorized by the Company authorities to report the case to police. (12)This Bus Inspector Tam Hung has been punished by the Company

to be degraded from the rank of Chief Inspector to an ordina- ry division inspector at the Tai Hang Road Station. (13) Magistrate

סי

has abused the Hongkong Magistracy

as the beautiful instrument for making money (14)Really, I have no case to answer. Victim Hongkong Retired
