In the course of the hearing of his Civil Action No. 2683/71 against the Attorney General,
alleged that certain documents had been fabricated by police officers. Mr. Justice Cons did not accept that allegation and his finding is at page 6 of his judgment, of which I enclose a copy.
In the course of the hearing of his libel action No. 2362 of 1974 against Nr. Morrin, Sgt. KHAN contended that Mr. Morrin wilfully concealed or destroyed or withheld documents and fabricated others. The watter is dealt with at pages 882-886 of the court record. I enclose a copy of the trial judge's ruling that there was no case to go to the jury but I also want to quote one extract from Mr. Justice McMullin's ruling. It is this

I have gone in some detail into these two points because they faily illustrate the weakness of the grounds on which the plaintiff was prepared to make confident assertions ascribing conduct of extreme depravity to the defendant and other persons.
The allegations as to forgery of documents rest upon grounds which are less substantial still."
Against this background, the Government cannot contemplate the appointment of a commission of inquiry in the interests, as you urge, of a man who has resorted to falsity and whose claims in the matter of his reversion in rank are not supported by any credible independent material.
