Annexed for the consideration of Honourable Members is the Summary Offences Ordinance (Exemption from section 13) (No 3) Order 1977 (Annex A).

Memorandum XCR(77)121 (Annex B) exempting remedial works to the landslip at Sau Mau Ping Public Housing Estate from section 13 of the Summary Offences Ordinance was considered by Members on 26th April 1977. The Council then advised and the Governor ordered that the Summary Offences Ordinance (Exemption from section 13) (No 2) Order 1977 should be made for the period from 29th April to 31st May 1977.

Recent rain has delayed work on the slopes, which cannot now be completed by 31st May. If there is further heavy rain, additional delay may result in mechanical work on trimming the face of the slope continuing until about mid-June.

To meet this contingency, and to ensure the stability of the slopes and the safety of the housing blocks as soon as possible, the Director of Public Works advises that night working should be permitted for a further two weeks in order to complete the works.

An order exempting work on these slopes from section 13 of the Ordinance is sought, from 1st June to 14th June 1977.

The Police have not received any complaints during the period of exemption which was authorised on 29th April, though the City District Officer, Kwun Tong, has received indications that some residents are becoming impatient over the continuing noise at night. However, there seems to be general understanding amongst people in the area affected that the remedial work is necessary, and must be completed at the earliest possible time.
