SUMMARY OFFENCES ORDINANCE (EXEMPTION FROM

SECTION 13) (NO. 5) ORDER 1977

In exercise of the powers conferred by section

13(4) of the Summary Offences Ordinance, the Governor

in Council has made the following order

section 13. (Cap. 228.)

Schedule.

This order may be cited as the Summary Offences

Ordinance (Exemption from Section 13) (No. 5) Order 1977.

2.

(1) Subject to paragraph (2), section 13 of

the Ordinance shall not apply to the construction of

the Aberdeen Tunnel carried out from the publication

hereof within the areas specified in the Schedule

until the 31st July 1980.

(2) The exemption granted under paragraph (1)

is granted subject to the conditions

•

(a)

that all plant and equipment shall be sound

reduced to a level of 50 decibels (dBA)

measured outside the nearest occupied

property for work between the hours of

8.00 p.m. and 6.00 a.m.;

(b)

that noise reduction equipment and baffling

arrangements appropriate to the areas

specified in the Schedule and approved by

the Director of Public Works shall be

provided and used within such areas;
