HONG KONG
LEGAL REPORT
Enclosure No. 2
THE SUMMARY OFFENCES (AMENDMENT)(NO. 2) ORDINANCE 1977
(No. 61 of 1977)
Section 4(26) of the principal Ordinance proved inadequate for the protection of the public from objects dropped from buildings and this Ordinance replaces it with a wider and more effective provision and a maximum penalty which is substantially increased. The new section 4B also imposes liability on contractors in the case of objects falling from buildings under construction or repair unless the contractor proves that he took reasonable measures to prevent the offence.
2. Before the Governor assented to the Bill in the name and on behalf of Her Majesty, I advised that he could properly do so.
