Genuine cultivator-families who opt for resite outside a layout instead of public housing will be offered an ex-gratia rehabilitation allowance of $5,000 per family but will forfeit their priority to public housing. Families not eligible for public housing will be offered space in a temporary housing area in Tuen Mun and may be eligible for ex-gratia domestic removal allowance.

In addition to the structures mentioned above forty-three (43) other ancillary temporary structures including two shops, pigsties, chicken sheds, a duck shed, etc, will also have to be cleared.

Negotiations to obtain voluntary surrender of the private land are in progress, but the institution of formal resumption proceed- ing is recommended to avoid delays which may be caused by succession difficulties or absentee landowners. As the land to be resumed lies within the Tuen Mun Outline Development Plan, the owners of agricultural land will be offered the alternative of land exchange entitlements on Letter B terms with a credit value at $10 per square foot or cash compensation which includes an ex-gratia sum to bring the total compensation up to $17 per square foot if it is accepted prior to the expiry of the resumption notice. Owners of building land will also be given an exchange offer or cash compen- sation. The amount of cash compensation paid will be reduced to the extent that land exchange entitlements are accepted.

Honourable Members will be asked to advise, under section 3 of the Crown Lands Resumption Ordinance (Chapter 124), whether the resumption of the lots listed at Annex B is required for a public purpose, namely the Stage II Development, Package 18 (Site Formation in Area 3) Tuen Mun New Town,
