MEMORANDUM FOR EXECUTIVE COUNCIL

Crown Lands Resumption Ordinance (Chapter 124)

RESUMPTION OF LAND IN AREAS 6 AND 39A NORTH TSUEN WAN, NEW TERRITORIES FOR THE CONSTRUCTION OF TAI LEK HO CULVERTS AND ROADS

A

As part of the comprehensive development of Tsuen Wan/Kwai Chung North, for which there is an item in Category A of the Public Works Programme, and for which many of the works are already in hand, various culverts have to be constructed in Areas 6 and 39A North Tsuen Wan, a stream known as Tai Lek Ho must be realigned and new roads and a major road junction must be constructed to serve Shek Wai Kok and Cheung Shan Public Housing Estates. The works will, on completion, facilitate the development of one of the central commercial areas of Tsuen Wan, and, subject to the approval of this Council (which will be sought very shortly), the grant of a site for a depot to the Mass Transit Railway Corporation.

The Director of Public Works has accordingly recommended the resumption of the land required for these works. This consists of

2 26974.8 m2 (290,360 square feet) of private land comprising 23973.8 m (258,057 square feet) of agricultural land, 295.2 m2 (3, 178 square feet) of building land with buildings, 929 m2(10,000 square feet) of private cemetery land and 1776.8 m2 (19, 125 square feet) of orchard land in Areas 6 and 39A of the Tsuen Wan/Kwai Chung Districts..

The general location of the land to be resumed is shown coloured orange on the identification plan at Annex A. The Secretary for the New Territories is satisfied that the area of private land involved is the minimum necessary to implement the project. Compensation for re- sumption and clearance is estimated at $6.51 million and sufficient funds are available within the approved project estimate to meet this expenditure provided that land exchange entitlements are accepted as expected.

The clearance will involve payment of compensation for crops, fruit trees, pine trees, miscellaneous items, ex-gratia allowance to cultivators, ex-gratia disturbance allowance for displaced pigbreeders and poultry farmers and compensation for the removal of graves and bone pots. Payment of Tun Fu ceremony fees as well as compensation for the

2 resite of 929 m' of private cemetery will also be required.
