Genuine cultivator-families who are eligible for public housing but who opt for a resite outside the layout to continue farming will be offered an ex-gratia rehabilitation allowance of $5,000 per family but will forfeit their priority for public housing.

In addition to the 231 temporary domestic structures, a total of 292 other temporary structures including 40 shops, 9 workshops, 9 restaurants, a primary school and an aquarium will also have to be cleared. Arrangements are being made for the pupils affected by the closure of the primary school to continue schooling in other primary schools in Sha Tin,

The institution of formal resumption proceedings is recommended to avoid delays which might be caused by succession difficulties, absentee landowners or negotiations to obtain the land not being concluded satisfactorily within the time available. As the land to be resumed lies within the boundaries of the New Town, the landowners concerned will be offered the alternative of land exchange entitlements on Letter B terms at a credit of $10 a square foot or cash compensation which will include an ex-gratia payment to bring the total compensation up to $17 a square foot if the cash offer is accepted prior to the date of reversion. The amount of cash compensation to be paid out will be reduced to the extent that land exchange entitlements are taken up.

Honourable Members will be asked to advise, under section 3 of the Crown Lands Resumption Ordinance (Chapter 124), whether the resumption of the lots listed at Annex B is required for a public purpose, namely site formation in Area 20, Sha Tin in connection with the New Town Stage I, Phase II Development.
