Crown Lands Resumption Ordinance (Chapter 124)

RESUMPTION OF LAND FOR TSING YI DEVELOPMENT,

AREAS 4, 5 AND 7 - PHASE III DEVELOPMENT OF

CHEUNG CHING PUBLIC HOUSING ESTATE,

TSING YI, NEW TERRITORIES

The development programme for Tsing Yi provides for a com- prehensive development scheme including land for public housing estates, private residential and industrial development together with associated amenities and facilities. On 8th January 1974, having considered memorandum XCR(74)5 Honourable Members advised and the Governor decided that the resumption of about 13, 220 square metres (142, 299.8 square feet) of private agricultural land in Tsing Yi Areas 4 and 5 was required for the construction of public housing. The Director of Public Works has now recommended the resumption of some 4.09 hectares (440, 528 square feet) of private agricultural land in Tsing Yi Areas 4, 5 and 7 for site formation for Cheung Ching Public Housing Estate, Phase III and for the construction of roads and drains for central Tsing Yi development. Funds for the resumption and clearance of the various development areas have been provided by means of a single item No NDE6(2) in Category A of the Public Works Programme.

The general location of the land to be resumed is shown coloured orange on the identification plan at Annex A. The Secretary for the New Territories is satisfied that the private land involved is the minimum necessary to implement the development. Compensation for resumption and clearance is estimated at approximately $8.88 million and funds are available in the approved project estimate to meet this expenditure provided that land exchange entitlements are accepted as anticipated.

The clearance will also involve Crown land and require the payment of ex-gratia allowance for cultivators together with compensation for crops, fruit trees, pine trees, the removal of formal graves, bone pots, fence, wells, water pipes and "tun fu" ceremony fees,

No building land is involved. However, eight (8) temporary structures used for domestic purposes (two (2) on private land and six (6) on Crown land) will have to be cleared. These temporary structures are occupied by twelve (12) families who if found eligible will be offered
