The development of North Tsuen Wan/Kwai Chung is a com- prehensive scheme which will provide land for a public housing estate, for private residential, commercial and industrial development and other related projects. Funds for the clearance of the whole area are provided under Public Works Item NDE 4(4) Tsuen Wan/Kwai Chung North Develop- ment Clearance, now in Category A.

On 11th December 1973 the Council advised that the resumption of certain land within Area 7 of the Tsuen Wan District Outline Zoning Plan was required for a public purpose, namely, the construction of the Shing On Housing Estate. Three villages were situated within the re- sumption limits but were not included in the resumption as negotiations were under way to obtain the voluntary surrender of the village land in accordance with the normal village removal policy.

The number of village lots excluded was eighteen of which eleven have been completely surrendered and two (which were in joint ownership) have been partly surrendered, on the terms described at Part I of the Annex to memorandum XCC(77)55 (attached here to as Annex A) which was considered by the Executive Council on 26th July 1977. The remaining owners have refused to accept these terms and are seeking more generous treatment. They do not have the support of the Tsuen Wan Rural Committee in this. Negotiations have been going on for over three years and a complete solution is unlikely to be achieved within the framework of agreed policy by further negotiation. Delays in site formation are being caused by the non-clearance of these areas. In these circumstances the Secretary for the New Territories considers that the only alternative is to resume the remaining land under the Crown Lands Resumption Ordinance (Chapter 124).

The general location of the land to be resumed is shown coloured orange in the identification plan at Annex B. Compensation for resumption and clearance is estimated to be $387, 000 and funds are available to meet the expenditure.
