MEMORANDUM FOR EXECUTIVE COUNCIL
Crown Lands Resumption Ordinance
(Chapter 124)
.3.0
HKK 365/1.
20 OCT
RESUMPTION OF LAND FOR CLEAR WATER BAY ROAD IMPROVEMENTS (FROM ANDERSON ROAD TO HIRAM'S
HIGHWAY) STAGE I SAI KUNG, NEW TERRITORIES
In order to widen the Clear Water Bay Road from Pik Uk to the Hiram's Highway junction it is necessary to acquire private land for construction work, project is in Category A of the Public Works Programme. The work is scheduled to commence in November 1977 and will take eighteen months to complete. The Director of Public Works has recommended the resumption of 549, 1 square metres (or 5,910 square feet) of private agricultural land which is required for the project. The Secretary for the New Territories is satisfied that the area of private land to be resumed is the minimum necessary to implement construction works. Compensation for resumption and clearance is estimated at $136, 000 and funds are available to meet this expenditure. The land to be resumed is shown coloured orange on the identification plan at Annex A.
2
The clearance will involve compensation for pine trees, crops, fruit trees, graves, bone-pots, ex-gratia allowance for cultivators, and compensation for the reprovisioning of water pipes, fences, gates and 'Tun Fu' ceremony fees.
3
Negotiations to obtain voluntary surrenders of private land are still in progress but the institution of formal resumption proceedings is recommended to avoid any delays which may be caused by absentee landowners or registration of succession.
4
Honourable Members will be asked to advise, under section 3 of the Crown Lands Resumption Ordinance (Chapter 124), whether the resumption of the lots listed at Annex B is required for a public purpose, namely the Clear Water Bay Road Improvements (from Anderson Road to Hiram's Highway) Stage I, Sai Kung, New Territories.
(The District Officer, Sai Kung (Mr R.I.W. UPTON) will attend before the Council for the discussion of this item).
