MEMORANDUM FOR EXECUTIVE COUNCIL

Immigration Ordinance

(Chapter 115)

DEPORTATION OF MR SOPHON CHANTATEYANONT

Under section 20(1)(a) of the Immigration Ordinance (Chapter 115), the Governor in Council may make a deportation order against an immigrant other than a Chinese resident, a United Kingdom belonger or a resident United Kingdom belonger who has been found guilty of an offence punishable with imprisonment for not less than two years.

Mr Chantateyanont was born on 17th June 1957 in Thailand. He arrived from Bangkok by air on 21st February 1976 and was per- mitted to remain as a visitor until 6th March 1976.

After passing through immigration controls at Kai Tak, Mr Chantateyanont was found by Preventive Service officers to have 2 3/4 lbs of morphine hidden in the soles of his shoes, Mr Chanta- teyanont was subsequently charged with 'trafficking in a dangerous drug', convicted in the High Court on 1st September 1976 and sen- tenced to 7 years imprisonment. With full remission he will be re- leased on 25th February 1981. The maximum penalty for this offence is, on indictment, life imprisonment.

Mir Chantateyanont is single and a former delivery boy. His parents are dead. He has a brother and 3 sisters in Thailand. He has no claim on Hong Kong,

The Director of Immigration considers Mr Chantateya- nont's continued presence in Hong Kong to be undesirable and re- commends that upon his release from prison he be deported to Thailand, where his re-entry is assured.

Honourable Members will be asked to advise, under section 20(1)(a) of the Immigration Ordinance (Chapter 115), whether Mr Sophon CHANTATEYANONT should be deported for life.
