RESUMPTION OF LAND FOR THE CONSTRUCTION HKK ROAD (P1), AREA 10 TUEN MUN, NEW TERRITORIES

On 26th October 1976, Honourable Members considered memorandum XCR (76) 217 and advised that the resumption of certain private land in Area 10, Tuen Mun was required for a public purpose, namely the construction of a primary distributor road (P1) through Tuen Mun New Town. The project is included in the Tuen Mun New Town Engineering Development Stage 1B Package 8A and is in Category A of the Public Works Programme, Road (P1) will connect the Tuen Mun Road Link with the existing dual car- riageway north of Tuen Mun New Town to complete the improved traffic route from Tsuen Wan through Tuen Mun to Yuen Long. The land previously resumed for this project reverted to the Crown on 9th February 1977. The Director of Public Works has now recommended the resumption of a lot of 36, 740 square feet (about 3,413 square metres) of building and garden land in Area 10 Tuen Mun New Town to facilitate completion of the next stage of this project which is under construction.

The general location of the land to be resumed is shown coloured orange on the identification plan at Annex A. The Secretary for the New Territories is satisfied that the land to be resumed is the minimum necessary to implement the project. The total compensation for resumption and clearance is estimated at $1, 12 million broken down into $1.1 million for resumption costs for land and buildings and $0.02 million for payment of compensation for flowers and fruit trees to be cleared. Funds are available in the approved project estimate to meet the expenditure.

In addition to the buildings on the lot, which are occupied by a caretaker, four temporary non-domestic structures on Crown land, namely a car shed, a watchman shed and two store-rooms will have to be cleared. No family will be displaced as a result of this resumption/clearance, therefore rehousing and payment of ex-gratia rehabilitation/building allow- ance will not be necessary.

Negotiations to obtain voluntary surrender of the land are in progress, but the institution of formal resumption proceedings is recom- mended to avoid delays which may be caused by, inter alia, prolonged negotiation with the owner. As the land lies within the Tuen Mun Outline Development Plan, the landowner will be offered the alternative of a
