The most direct route between the housing estate and Castle Peak Road is that followed by the existing earth track. For the reasons given in paragraphs 3 and 4 above, it is proposed to resume a total area of 178, 673 square feet (about 16, 599 square metres) of private agricultural land comprising mainly the existing earth road and the site of a new bus bay. The existing bus bay at the junction of the earth road with Castle Peak Road will be affected by construction of the proposed new access road and will have to be resited further south along Castle Peak Road when construction starts. After the water mains have been laid, the company will be obliged to construct the proposed access road to approved standards and hand it back to Government on completion.

The location of the land to be resumed is shown colured brown on the identification plan at Annex A. The Secretary for the New Territories is satisfied that the land to be resumed is the minimum necessary to implement the project. Compensation for resumption and clearance is estimated at $720,000 and funds are available under Head 67 Public Works Non-Recurrent: Headquarters - Subhead 450 Compen- sation for Surrenders and Resumptions Item 005 Miscellaneous.

The clearance will only involve payment of compensation for a gate and fence on Lot No 3250 A1 in Demarcation District No 104. No building land is affected and no structures temporary or otherwise will have to be cleared. As stated above, the land to be resumed is already in use as a road and is not cultivated.

Honourable Members will be asked to advise, under section 3 of the Crown Lands Re sumption Ordinance (Chapter 124), whether the resumption of the lots listed at Annex B is required for a public purpose, namely the construction of an access road and bus bay and the laying of water mains to private development at Tai Shang Wai, Yuen Long, New Territories.
