allowed a further three months' extension of time to enable him to raise the money to pay the 5th instalment. Following approval of the further extension which expired on 7th August 1938, the petitioner again paid the interest but failed to pay the instalment. A third and final extension of three months was granted to allow the petitioner to meet the outstanding commitment and he was informed by the District Officer, Tsuen Wan, on 22nd August 1968 that if the payment was not made by 7th November 1968, action would be taken to re-enter the two lots.

The 5th instalment remained unpaid at the end of the third and final extension period and the petitioner subsequently informed the District Officer, Tsuen Wan, by a letter dated 25th January 1969 that he had no intention of paying either the outstanding or any subsequent instalment and asked the Government to accept free surrender of the lots. Subse- quently, the Crown exercised its right of re-entry and a Memorial of Re-entry was registered in the District Land Office, Tsuen Wan, in respect of the two lots with effect from 7th March 1969.

Since re-entry, the site has been left vacant (although some squatting and occupation by adjoining shipyards and their workers has occurred against which clearance action has been taken from time to time). At the time Mr TONG Kow's petition was received, it was being processed for disposal by public tender.

On 6th September 1976, more than seven years after the expiry of the statutory six-month period from the registration of the Memorial of Re-entry, a petition under the repealed Crown Rights (Re-entry) Ordinance was forwarded on behalf of Mr TONG Kow by Messrs Thomas Wong and Company, Solicitors, seeking extension of time within which to file a petition and relief against the re-entry of Lots 607 and 608 in Demarcation District 436. A copy of the petition is annexed, which seeks relief against re-entry on the following grounds:

(a) the delay in petitioning was caused by financial hardship

on the part of the former owner, who is now prepared to pay all the outstanding instalments of the premium;

(b) the petitioner is now in possession of working orders

for the repair and construction of ships from the Marine Department and Public Works Department and intends to develop the site to meet these orders;

(c) the lots in question have not yet been designated for

development purposes nor have any plans been made for their use; and
