MEMORANDUM FOR EXECUTIVE COUNCIL

RESUMPTION OF LAND IN THE NEW TERRITORIES

AND RELATED LETTER A AND B POLICY

On 18th May 1976 after considering memorandum XCC(76)18 — HKR 365

(extracts attached at Annex A) concerning the acquisition and clearance of land, Honourable Members advised and the Governor ordered inter alia that:

(a) the present system of land exchange entitle-

ments should continue;

(b) Executive Council should be informed every six months of the amount of land required to meet outstanding "Letter B" commitments and the amount of land available for disposal; and

(c)

a memorandum concerning the reservation of limited areas for local exchanges should be submitted to Council in about six months.

Letter B Commitments

In accordance with the decision recorded at (b) above, a schedule of outstanding commitments is attached at Annex B. Honourable Members will note that substantial commitments are outstanding from resumptions in the sixties. This arises from a variety of causes: resumptions were taking place in the sixties without a systematic attempt to match the quantity of land resumed with that required for exchange; larger areas were earmarked for public housing than originally planned; exchange entitlements held by clans tend to remain unsold, and other owners may have retained their exchange commitments for sites of high value.

Schedules of land which will become available in 1977 and 1978 are also attached at Annex C. From these it will be seen that, numerically, enough land will have been provided by the end of 1978 to extinguish commitments up to the end of 1974. In practice, however, it is likely that the Letters B exchanged will include both pre- and post- 1974 entitlements, since owners of the older and more valuable entitlements are reluctant to exchange them for sites with restricted coverage.
