MEMORANDUM FOR EXECUTIVE COUNCIL
OBJECTION BY MR YAM CHI-HEI AGAINST REFUSAL OF MADAM LY MUOI'S APPLICATION
TO ENTER HONG KONG FROM VIETNAM
Annexed for the consideration of Honourable Member is
an objection by Mr YAM Chi-hei under section 53 of the Immigration Ordinance (Chapter 115), against the Director of Immigration's decision to refuse the application of his alleged wife, Madam LY Muoi, to join him for residence in Hong Kong.

Mr Yam first applied for the entry of Miss Ly in January 1976, stating that he had met her for the first time during a brief visit to Vietnam between 20th January 1974 and 28th January 1974, that she was his fiancee, and that they desired to get married in Hong Kong. The application was refused in February 1976 since Madam Ly did not qualify to be admitted as the petitioner's dependant and she had no other claim on Hong Kong.

Mr Yam then re-applied for Madam Ly's entry, claiming she was his wife, and producing a Vietnamese marriage certificate dated 28th January 1974. The petitioner also stated that he and Madam LY Muoi had known each other since childhood, and had registered their marriage during his eight-days visit to Vietnam in January 1974. From its knowledge of Vietnamese marriage registration procedures, the Immigration Department judged this marriage certificate to be false and confirmed its earlier refusal,

In May 1977, the petitioner submitted a third application, but without producing any new factors for consideration. This was refused on 29th September 1977. It is against this decision that the present objection is lodged.

Following the receipt of Mr Yam's petition, the British Embassy in Hanoi has confirmed that the marriage certificate was not genuine.
