Thank you for your letter of 8th August, copied to Hanoi, about this case. The facts as set out in the petition are so far as we know correct.

The petitioner is an eight year old girl who acquired citizenship of the UK and Colonies by accident of birth in Hong Kong, during a visit by her mother, who holds a Taiwanese passport. The girl's father Mr. TAN Tse-chuan is also a Taiwan passport holder. Mr. TAN is aged 50, and although he was born in China, he has lived in Vietnam for the past 22 years. His other three children were born in Canton, China, between 1961 and 1964.

Mr. TAN applied in January 1977 for visas for himself and his family to join his sister for settlement in Hong Kong. The sister is married to a H.K. resident, and has lived here for 17 years. She has a family of two children.

The admission of family members is restricted, under our immigration policy, to close relatives, such as wives joining husbands and children under 21 joining parents. There is discretion to approve other cases, and this is exercised liberally in border-line cases. However, this was not thought to be a border-line case, and was refused accordingly.

Perhaps I should explain that the petitioner herself has an absolute right of entry to Hong Kong by virtue of her birth here, and does not therefore require a visa at all. The birth of a child here does not

however give the parents or other family members any right to reside in H.K.
