4th March 1977 when in an Action against two aiders and abettors a Magistrate ruled that the defendants had no case to answer as he was not satisfied that the Crown had proved that the illegal immigrants concerned did not have a right of entry to Hong Kong. This was further publicised when in a similar case on 7th April 1977 the same Magistrate awarded costs in favour of the defendants. The Immigration Amendment Bill 1977 (annexed) is designed to overcome this difficulty, and is unlikely to attract any adverse public reaction.

Honourable Members will be asked to advise whether the Immigration (Amendment) Bill 1977 as annexed should be introduced into the Legislative Council.
