OBJECTION FROM MR CHENG HING-TO AGAINST THE REFUSAL OF MR TRINH TRONG HUNG AND
FAMILY'S APPLICATION TO ENTER HONG
KONG FROM VIETNAM
Annexed for the consideration of Honourable Members is
an objection by Mr CHENG Hing-to under section 53 of the Immigration Ordinance, (Chapter 115), against the Director of Immigration's decision to refuse the applications of his younger brother Mr TRINH Trong-hung and family (wife, Madam NGO Thi-muoi and four minor children, TRINH My-nhỉ, TRÌNH Kiet nhi, TRINH Cam xuong and TRINH Kien-xuong), to join him for residence in Hong Kong,

The facts set out in the petition are not in question. The reasons for the Director of Immigration refusing the request are:

(a) This application does not fall within the policies
on entry to Hong Kong approved by the Executive Council. These policies allow, in general, for the entry of immediate relatives of Hong Kong residents, but do not provide for a married man of working age and his family to join a brother in Hong Kong. These approved policies are being applied to all applications received from residents of Vietnam,

Whilst the policies on entry provide for the Director of Immigration to make exceptions where there are strong humanitarian or other special grounds, in this case a departure from policy would not appear to be justified,
It is relevant that from early 1976 to 20th August 1977 the Immigration Department has received applications in respect of 23, 773 persons in Vietnam for permission to enter Hong Kong. Entry visas have been approved in respect of 3071 persons whose applications are within policy, and 13,014 are still under consideration, Applications in respect of 7, 688 persons have been refused and many of these are comparable with those of Mr Trinh and his family.
