Explanatory Note
These regulations amend the form of recognizance
under section 36(1) of the Immigration Ordinance by providing
that, where a person enters into the recognizance, he is to
report, in the case of a police recognizance, to the duty
officer at a specified police station on the days and
between the hours specified in the recognizance and, in
the case of an Immigration Department recognizance, to the
duty officer of the Department's Investigation Division,
also on the days and between the hours specified in the
recognizance.
The regulations also provide for a new form of
recognizance, to be taken before a magistrate, to be used
where a person may become liable to be detained under
section 32(2) of the Immigration Ordinance pending removal.
