in the case of (vi) and (vii), on the grounas tnat the value of the property will be adversely affected. Upon completion, the flyover will be between 10 and 16 metres above these premises and the footpath will be widened. No significant effect on business is therefore likely to be felt. Although Hill Road will be partly obstructed during construction of the flyover, the buildings will not be directly affected by the works and a 3-metre footpath will be maintained throughout the period of construction.
Claim Number 8
The Hong Kong Tramway Company Limited has indicated that it may claim compensation if its regulator shelter on Connaught Road West is affected by the flyover construction. However, the flyover will pass high above the shelter which will not therefore be affected by the project.

Mr PANG Ke-wing, owner of first floor premises at 62 Hill Road, has lodged a claim for compensation on the grounds that the flyover will cause environ- mental deterioration, impair the health of residents, cause damage to the premises and result in a depreciation of their value. The building will not be directly affected by the undertaking as the flyover will be 4.6 metres from it.

While it is not possible to build a flyover which will not affect property and the environment to some extent, the present alignment over Hill Road has been chosen in preference to the original route along Water Street because the effects will be far less serious. Much has been done in the design of the undertaking to reduce these effects still further. As much clearance as possible, bearing in mind traffic and construction requirements, has been maintained between the flyover and buildings adjacent to it and concrete parapets will help to reduce the effects of noise and dust. Upon completion of the flyover, there will be less traffic at ground level than at present. As it would not be possible to modify the undertaking to the extent necessary to secure the withdrawal of the objections, it is proposed that it should be approved without modification under section 6(1) of the Ordinance. Thereafter claims of pecuniary loss or damage arising from the under- taking can be dealt with under section 4(2) of the Ordinance and pursued, if necessary, to the Lands Tribunal under section 7 of the Ordinance.
