(i) There is no imprisonment without

trial as such, although the duration of pre-trial custody can be unduly long, as elsewhere on the Continent. The domestic laws relating to com- pensation for unlawful arrest are inadequate, and are arguably against the spirit of Article 9 of the Con- vention. The rating should ideally be, since the drawbacks we have described are the result of short- comings in the system and not of deliberately oppressive measures.
