The independence of the Judiciary is not in doubt, but what this means in South Africa is that there is fair and impartial implementation by the judiciary of unjust laws.

There is no legal bar on the development of trade unions but Black unions cannot be registered as such in law, and the government and most employers refuse to recognise them.

Both White and non-White South Africans are occasionally deprived of their pass- ports, or refused entry into South Africa. Apartheid legislation denies non-Whites freedom of movement within South Africa.
