(i)
There is some evidence that the provincial authorities in Romania make unreasonable use of the powers of pre-trial detention but the extent of this is not known. The legal procedures are observed so that formally the authorities do not seem to be in conflict with the provisions of the International Covenant on Civil and Political Rights (ICCPR). However, the enforceable right to compensation for a victim of unlawful arrest or detention almost certainly does not exist in practice.
(ii) Well publicised allegations of torture
have been made in the past but there has been no recent evidence of more than rough handling.
(iii) Slavery does not exist in Romania.
(iv) Restrictions on importing and receiving
information of a political nature are very tight. Expression of opinion contrary to current official views is not permitted.
(v) The Judiciary is formally independent but
is in the final instance under Party control.

(vi) Workers are encouraged to join trade
unions. The General Confederation of Trade Unions is controlled by the Communist Party. No unions are allowed to exist outside the General Confederation.

(vii) Authority to emigrate has been increasingly
difficult to obtain.
