Mr Ratford from the Embassy in Paris rang me yesterday about 13 Hong Kong telno 790. Having spoken to Hong Kong Department, I told
Mr Ratford that we had no objection to his approaching the French as requested by Hong Kong. I explained to him about the Commission regulation of 12 July. The position was that the Commission had the right to take measures on behalf of the Community but this had to be confirmed by the Council within 6 weeks. The Commission regulation was therefore definitive during that period.
2. The French had, however, made it clear that they would not necessarily abide by the Commission regulation. The Commission's action was approved by the Council on 26 July with some alterations. The Commission regulation was therefore being turned into a Council regulation. This was being circulated for approval by the written procedure. The document is S/1286/77 (COMER 2517 The UK has already given its agreement. I aia not know the position of other Member States; but I have no reason to expect that any of them would dissent. From the French attitude at the Council, it seemed that they would also act in accordance with the Council regulation and would with raw any unilateral measures they still had in force. But what was not clear was whether they ha already done this or whether they would wait until the regulation came into force, thereby superseding the Commission regulation. It was the answer to this that Mr Ratford would try to elicit from the French.
