1. We spoke about the draft reply to Mr Hooley's PQ on Hong Kong and the UN. date Resolution 2908 (XXVII) was adopted was 2 November 1972. I suggest this should be included in the fourth line of the draft reply between "Resolution 2908 (XXVII)" and "of a recommendation".

For your background information, I told you that the UK had voted against Resolution 2908 (XXVII) because it did not agree that Hong Kong should be taken off the list of non self governing territories to which Article 73e of the United Nations Charter applied. It was decided that the UK should not make any statement in the General Assembly; its views were to be put in a letter to the Secretary General. The letter in question was the one to which you referred of 14 December 1972 from Sir Colin Crowe.

3. Arising from your minute of 8 December, I should like to make one other comment. You say in paragraph 2 that it is HMG's view that the transmission of information under Article 73e of the Charter is a voluntary act on the part of the administering power. To the best of my knowledge the UK has never held this view. It has, however, held that the decision as to when a territory has ceased to be a "non self governing territory" should be taken by the administering power and not to United Nations.
