As regards legislation, two Ordinances will be required.

to bring the MTR into operation. These are:

(a) An Ordinance to allow Government to acquire

compulsory rights of way and easements in land or buildings along and adjacent to the alignment of the ITTR. Although in recent years Government has retained or acquired some land for this purpose, it must now acquire such rights in land or buildings, on payment of compensation, as are necessary to establish stations, ventilation shafts and other facilities essential to the construction of the TR.

(b) An Ordinance to set up a lass Transit Railway

Corporation. The Ordinance will empower the Corporation to take over all the land and rights in land and buildings which Government has acquired for the MTR under the Ordinance at (a). The Corporation will be given the power to bore tunnels, without compensation except where physical damage to property is caused thereby. The Corporation may delegate its powers to agents or contractors working on its behalf. The Ordinance will provide for compensation for land owners, owners of buildings and statutory undertakers whose land, buildings or installations are affected by the construction of the MTR.
