Government will hand over this information in good faith and will use its best endeavours to ensure its accuracy, but the Consortium must satisfy itself as to its correctness and sufficiency. Arrangements for deciding where financial liability should rest, should additional information be required as a result of inaccuracies being revealed in the information originally provided, will be discussed in the negotiations for the Formal Contract.

The Consortium shall, during the period from the date hereof until the signing of the Formal Contract, proceed with the preliminary works set out in Appendix "B" annexed hereto in order to facilitate the start of the project construction.
By the end of each month during such period, the Consortium shall submit to Government for approval a schedule and budget for such preliminary works intended to be carried out in the following month. Any change in any such monthly schedule or budget shall be subject to prior approval in writing by Government, which shall not be unreasonably withheld. Government shall reimburse the Consortium actual expenses disbursed by the Consortium in the previous month in accordance with the approved schedule and budget.
The amounts paid by Government under this paragraph shall be treated as partial payment of the contract price in the event that a Formal Contract is entered into between the parties.
Government agrees that, for the purposes of the timely commencement and performance of the project construction, it will undertake to provide the Consortium free of charge with the requirements set out in Part I of Appendix "C" annexed hereto and will assist the Consortium in arranging or performing the matters set out in Part II of that Appendix. Except insofar as the Consortium's requirements in Part I of Appendix "C" are required before the Formal Contract is signed, the final details, to be agreed with Government, of these requirements and quantities (where applicable) will be set out in the Formal Contract.

In the event that the negotiations do not result in the Formal Contract being signed, Government shall pay to the Consortium all accounts remaining unsettled pursuant to paragraph 9 above and, upon such payment being made, all materials and works acquired or carried out by the Consortium, or otherwise paid for by Government, in connection with the preliminary works shall become the property of Government and each party shall
