Mr. Durden asked the Secretary of State for the Home Department if he will intro- duce legislation to stop the destruction of badgers by what is known as badger digging.

Mr. George Thomas: My right hon. Friend has no such proposals in mind at present, but he will be glad to consider any evidence of the need for control which the hon. Member may wish to let him have.

Death Sentences

Mr. Walker asked the Secretary of State for the Home Department, in view of the decision of the House on the Second Reading of the Murder (Abolition of Death Penalty) Bill, what course he pro- poses to adopt in considering cases of persons sentenced to death under the present law.

Sir F. Soskice: My right hon. Friend the Secretary of State for Scolitand and I have given careful consideration to this matter. It would be unconstitutional far us to abrogate capital punishment by administrative action in anticipation of the amendment of the law; it is our duty to apply our minds to the circumstances of each particular case. In doing so we shall have regard to all relevant considera- tions, including the recent decision of the House.
