On 24th July 1974 LI Tung-yau and TSUI Kwok-kin were

convicted of the murder of KWOK Chun-kwan and were sentenced to death. A copy of the trial judge's report on the case is at Annex A.

An appeal by Li and Tsui against conviction was heard and dismissed by the Full Court on 17th December 1974. A copy of the judgment is at Annex B and a note by the Attorney General is at Annex C.

Petitions for clemency through the prisoners' solicitors are at Annex D.

Also annexed are reports by the Secretary for the New Territories (Annex E), reports by probation officers (Annex F) and police antecedent statements (Annex G).

Honourable Members will be asked to advise whether the law should take its course or whether the sentences passed on Li and Tsui should be commuted. (If His Excellency decides that the sentences should be commuted, Honourable Members will be asked to advise on the sentences of imprisonment which should be substituted for the death sentences).
