That your petitioner now petitions His Excellency to commute his death sentence and also to uphold justice in his case. Meantime, he respectfully submits for His Excellency's consideration the following background and facts:-

Your petitioner came from Mainland China in 1962. He got married in 1967 and settled down in Sau Mau Ping Estate, Kwun Tong. Besides his wife and two children, ho only has an uncle FONG HING SHUI in Hong Kong. In 1970, he set up with his friends by joint partnership a beading embroidery workshop named as CHUNG LAM BEADING EMBROIDERY CO. at 89, FU YAN STREET, 8/F, Apartment E, Kwun Tong (near to YU MAN SQUARE). Meanwhile, he also ran a fixed fruit selling stall at YU MAN SQUARE where there were more than twenty such stalls and many other vendors selling other sorts of articles. Since he was busily engaged with the beading embroidery business, the fruit selling business was left to the care of his wife and a friend. A year later, all his friends withdrew their partnership from the workshop because.. of poor business. He then changed the name of the workshop as 'CHUN FAT BEADING

· EMBROIDERY CO. and continued with the business until the end of 1972 when the rental contract of the workshop expired. For the next few months, he concentrated on the fruit selling business.

In early September, 1973, your petitioner was informed by the beading suppliers that the trade became prosperous again. They advised him to set up a beading embroidery workshop in Macau where the rent and wages were much lower. He therefors left the fruit selling business to the care of his wife and friend again. Then he started making arrangements to set up a beading embroidery workshop in Macau. His msin problem, however, was short of capital. On the evening of September the 8th, he received a phone call from his uncle telling him that he was going to visit and send some presents as festival greetings to a friend CHAN YUM in YUNG SHU WAN, Lamma Island the next day. (The Mid-Autumn Festival was drawing near). On hearing this, he requested his uncle to let him go as well so that he could take this chance to raise more capital.

3. At approx. 1.00 p.m. on Sunday, September the 9th, your petitioner and his uncle left Kwun Tong for Lamma Island. They reached YUNG SHU WAN and arrived at the SAY LUK CO. owned by their friend at approx. 5.00 p.m. Their friend CHAN YUM and wife CHENG BIK WAN were out on certain business. There was only CHAN TSANG, one of the partners, at the company. They were, however, entertained a nice dinner at a tea-house nearby by CHAN LUK, father of CHAN YUM. Eventually, he was requested to stay behind in his friend's home until September the 14th when he left for Macau, He came back to Hong Kong in November, 1973 and was immediately arrested by police.
