of mind told them there was a police road block ahead whereupon they

immediately told him to turn left. He did so and arrived at a cul de

sac where the three persons left his taxi. The driver informed a

policeman who went to the cul de sac where the three persons were then

walking. He called upon the three persons to stop. The one with the

knife ran and escaped but the other two stopped. One of them was

MA Sung-lee who was taken into custody.

The other was KWOK Ki-cheong

MA Sung-lee who said he is aged 23 years gave evidence

denying he had taken part in the attack or been in a taxi. He said

he himself had been attacked close to Yue Man Square when on his way

to a cinema. He said he had been running from his attackers when he

was called upon to halt by a police officer. He said he was apprehended

at a place a considerable distance away from where the prosecution

witnesses alleged. The jury, rightly in my view, disbelieved him,

accepted the prosecution evidence and concluded that he had been one

of the attackers in the lane.

KWOK Ki-cheong who said he is aged 24 years gave evidence of

an alibi and called a witness to support him. The jury, in my view

quite rightly disbelieved both the accused and his witness, accepted

the prosecution evidence and concluded he was a member of the attacking

party in the lane.

FONG Chong-ming and NG Lee-kin were identified by various

victims as having been in the lane taking part in the attack.

Each was

identified as having been seen running through the lane with a white

cloth in his mouth and a knife in his hand, chopping people. Some of

the identifying witnesses knew the accused prior to the attack, other

identifying witnesses did not know them previously. The statements

made by the witnesses to the police shortly after the attack were

frequently not in accord with the evidence given by the witnesses in Court.

These discrepancies in large part consisted of failure to mention in

the statements accused persons known to the witnesses by name, but

whom they later identified as attackers. Various explanations were

put forward for these inconsistencies, including language difficulties
