MEMORANDUM FOR EXECUTIVE COUNCIL

DEATH SENTENCES PASSED ON MA SUNG-LEE, KWOK KI-CHEONG, FONG CHONG-MING ALIAS FONG MUK-TUNG, NG LEE-KIN ALIAS FONG LEE-KIN

On 19th November 1974, MA Sung-lee, KWOK Ki-cheong, FONG Chong-ming alias FONG Muk-tung and NG Lee-kin alias FONG Lee-kin were convicted of the murder of LAM Po alias LAM Sun-shui and were sentenced to death. The trial judge's report to the Governor is at Annex A.

The prisoners' appeals against conviction were considered

by the Full Court and dismissed on 8th April 1975.

NG Lee-kin committed suicide in his cell at Stanley Prison on 18th May 1975, His petition together with those of MA Sung-lee, KWOK Ki-cheong and FONG Chong-ming are at Annex B.

Also annexed are reports by the Director of Home Affairs (Annex C), reports by probation officers (Annex D), police antecedent statements (Annex E) and a note by the Attorney General (Annex F).

Honourable Members will be asked to advise whether the law should take its course or whether the sentences passed on the prisoners should be commuted. (If His Excellency decides that the sentences should be commuted, Honourable Members will be asked to advise on the sentences of imprisonment which should be substituted for the death sentences).
