eight years and has been hospitalised on a number of occasions. Despite of

his lack of education, his iamilly poverty and ill-health Your Petitioner has

always been a law-abiding citizen and in short a young man with no previous

convictions.

Your Petitioner's father is 54 years of age and is casual worker in

painting tar to wooden planks used for building piers. He earns approximately

$50.00 a day but had recently been suffering from intestine trouble. He is

illiterate and is the main bread winner of the family. The mother of Your

Petitioner is an odd job worker and takes in about $45,00 a day, Your Petitioner

has two brothers and three sisters who are either working or studying in Hong

Kong.

The facts presented by the prosecution and accented by the jury

which led to the conviction of Your l'etitioner are as follows :-

At 8. 50 a. m. on the morning of 14th August 1873 a public car bearing registration No. AVS296 was hailed by four Chinese males outside a teahouse in Kowloon. Three of the Chinese n.ales got Into the back seat whilst one sat in front. One of the men in the back produced a revolver and tüc driver was forced to drive the car to Clearwater Bay Road. There the driver was forced to walk down the hillside for some 300 - 400 yards into some bushes and was tied up and gagged. The war was then driven away by the assailants.

At about 11, 10 a. mi. of the same day eight Chinese males entered the Chartered Bank situated at the corner of Cheung Wah Street and Un Chau Street in Shanishulpo. Six were wearing hoods and two were wearing (orage caps. Of the eight, four carried guns and two carried knives. Inside the bank a security guard had his revolver snatched by a robber and he was hit on the head and neck which rendered him unconscious. During the robbery a messenger was also hit on the head with a revolver and another security guard had his revolver snatched. Before the robbers left the bank three female staff members were forced to leave the bank with them two of the three girls were released outside and one was forced to get into a vehicle.
