Afterwards, I got a car and fled

In the afternoon of the 15th August, the day of his arrest

No.3 was questioned about other crimes and he made a long statement.

At the end of it he said "... When I robbed the Chartered Bank at

Un Chow Street, Shamshuipo, a Sergeant wanted to apprehend mo, so I

fired four shots at him". In his answer to the charge of murder No.3,

after exonerating the 8th accused continued: "Amongst the others I alone

shot with the gun and that hit the sergeant.

Because he was chasing

after us and for the purpose of self defence, so I shot with the gun to

hit him. Originally I had no intent to kill him.

also shot with their guns but they did not aim to hit at the policemen.

I saw the policemen were chasing after us, and my elder brother (No.1)

had fallen onto the ground, so I had to fire my gun at the sergeant' who

was chasing and nearest to us. When he was hit and fell, we again ran.

Somewhere near Pei Ho Street, we robbed a Honda car and drove home.

After going home, we again went to (the 8th accused's) house to join the

others. By the time of my arrival, I already had two guns; one I took

along with me and the other was snatched from the bank. I handed the

two guns to (No.7). Then (No.7) put all the guns into (the 8th accused's)

drawer. After having split the money that had been robbed wo left

individually."

Although it is impossible to say from the jury's verdict who

fired the shot it is my opinion that the fatal shot was fired by No.3.

Among my reasons for saying this are two which I consider cogent.

The first arises from an identification of weapons a number

of the accused made. The six revolvers recovered were put on display

and given an identification letter. Each accused was brought in separately
