All the accused gave evidence.
The 1st accused, who had pleaded guilty to the robbery charge,
said that when he descended from the red car he ran along the footpath

of Pei Ho Street towards Tai Po Road with his younger brother, No.3. somewhat
behind him. He said he knew he was being chased but he never stopped
When he was about three or four shop spaces past the
nor looked back.
Light Bus he fell. He heard a number of shots, but from where he did
not know. He felt someone helping him to his feet and realised it was
his brother, No.3. He dropped the bag of money he was carrying, he
said, and he and his brother ran to Tai Po Road. There he commandeered
a car to escape. He said that while driving off he felt a policeman
was chasing him so he fired at the verandah (or footpath) and heard
glass breaking. He said the glass broke about 18 feet from where
the police constable was standing.
No.3 was not seen by any prosecution witness in Pei Ho Street;
he was placed there by his own evidence, that of the 1st accused and by
his answer when charged with the sergeant's murder.
He said that he and about five others alighted from the red
car, and he and the 1st accused ran along Pei Ho Street towards Tai Po
Road; the others ran along another street. He said he followed the 1st
accused and heard a shot fired and saw his brother fall at a place which
would have been to the rear of the bus (and would, indeed, have been
about the place where P.C.2752 said he was when he saw the 1st accused
draw his revolver. The 1st accused said he fell in front of the bus).
He said he thought his brother had been shot and he ran to help him.
He said he was very frightened and as he helped his brother he fired
several shots. He said his only intention was to frighten off the
police. He said he saw a policemar fall. He and the first accused
then commandeered a motor car and both got in. He said the 1st accused
fired a shot and he heard glass lettering.
