On 26th June 1974, the above named were convicted of the murder of a police sergeant and were sentenced to death. The report to the Governor by the Honourable Mr Justice Trainor, the trial transcript and the judge's summing-up have already been circulated. Honourable Members may wish to study again the trial judge's report at Annex A.

An appeal by the prisoners against conviction was considered by the Full Court and dismissed on 2nd December 1974. Copies of the judgment of the Full Court are at Annex B and a note by the Attorney General is at Annex C.

Petitions for clemency by the prisoners are at Annex D. CHAN Hung's petition, sent through his solicitors, is at Annex E.

Also annexed are reports by the Director of Home Affairs (Annex F), reports by probation officers (Annex G) and police antece- dent statements (Annex H).

Honourable Members will be asked to advise whether the law should take its course or whether the sentence passed on the prisoners should be commuted. (If His Excellency decides that the sentence should be commuted, Honourable Members will be asked to advise on the sentence of imprisonment which should be substituted for the death sentence).
