That your petitioner was sentenced to death for an offence of murder
on the 15th July, 1974 and his application for leave to appeal against convict- ion was dismissed on the 9th September. He now wishes to petition His Excellency for clemency.
He claims that he has nothing to do with the murder of the deceased, and in support of his petition, he submits this brief account of the incident.
On the 19th December, 1973, about 5 0 clock in the afternoon after he finished his day's work, he came across a friend, CHAN, in the street. CHAN invited your petitioner to accompany him to James Bond Restaurant to get back some money from a friend of CHAN, who was later deceased. Your petitioner dic not know this friend of CHAN at all. Inside the restaurant, CHAN and his friend had a quarrel; they subsequently started a fight. Your petitioner did try to separate them and in so doing, he himself was stabbed on the leg by CHAN too. CHAN ran away some time later while your petitioner followed. However, as his leg bled too much, he stopped at a car and tried to bandage his wound inside. Owing to the fact that he had lost too much blood, he lost consciousness, until he was discovered by police officers. He was so frightened that he dared not reveal the truth.
In May, 1974, he was tried at court, but the trial judge ordered a re-trial because there wasn't a unanimous vote by the jury against your petit-
In July, 1974, with a different jury, your petitioner was ultimately found guilty of murder and awarded the capital punishment. His appeal to the Full Court was dismissed.

Your petitioner now prays His Excellency for mercy. He was born in Hong Kong, and has resided here ever since; at the age of 18, he began to work to support his aged parents. He was a driver before his being arrested. He has been a law-abiding citizen and hasn't committed any offence. He didn't know that he would be involved in a murder when he followed his friend to the restaurant. He has never dreamed before that he would be condemned. and penitent, he, can but crave His Excellency to pardon his death penalty and instead award him imprisonment. He is only 23 years old and is only too anxious to be granted a chance to turn a new lease of life. He begs His Excellency again to consider his petition.
