evidence that the searching police heard anybody shout for help.

Their evidence was that they found the prisoner lying down in

the back of the lorry.

On the evidence as a whole I am in full agreement with

the verdict returned by the jury. Nobody knows why the prisoner

went to the James Bond Restaurant or why he stabbed the deceased

or how he was wounded in return. His motive may have been one of

robbery. However evidence was adduced by the managing director

of the restaurant that nothing had been taken from the premises.

The prisoner may have been foiled in his attempt to rob by the

deceased, and having been wounded ran away without taking anything.

I do not know. But it is clear from the evidence as believed by

the jury that the prisoner did go to the James Bond Restaurant on

the night in question armed with a knife which he used to fatally

stab the deceased.

From the above it is clear that no mitigating circumstances

arose out of this case, but should Your Excellency decide to commute the death sentence I would respectfully recommend that a sentence

of 20 years' imprisonment be substituted for the sentence of death.
