with him knew that the deceased was the father of the man who

hired them to do the killing.

MEDICAL EVIDENCE.

The deceased had 6 stab wounds in the chest. of them penetrated the chest cavity, passed through the diaphragm and caused a wound at the front of the stomach. other wounds on the left chest penetrated the diaphragm, the liver and the front of the stomach. The cause of death was shock and bleeding from the stab wounds.

DEFENCE.

KWAN's defence was that he was hired to teach the deceased a lesson by giving him a beating. He said that he and the others also intended to steal. The deceased was tied up because he resisted them, but KWAN said that he did no serious harm to the deceased and in effect suggested that the killing must have been done by the two who went with him.

SUMMARY,

There was ample evidence in my opinion to support

the verdict of murder against KWAN.

PRINCIPAL FACTORS.

10. (a) This was a carefully planned murder of the utmost

callousness. KWAN was a hired killer.

11.

(b) KWAN, having been introduced to the deceased's son

by someone, became the ringleader.

RECOMMENDATION.

If the Governor decides to commute the death sentence, I recommend that a sentence of life imprisonment be substituted.
